The City of Durham adopted the provisions of Section 37 of the Local Government (Miscellaneous Provisions) Act 1982 with effect from 1st May 1987.
These provisions require any person intending to hold a temporary market (including car boot sales), or the occupier of any land who gives consent for the holding of a market, to notify City of Durham Council at least one month in advance of the proposed date(s).
Any person who fails to give the required notice and holds a temporary market, or permits land occupied by him/her to be used as the site of a temporary market, will be guilty of an office and liable to prosecution.
Anyone planning to hold a temporary market is also advised to contact the City of Durham Council's Planning Department to ascertain whether or not planning permission is required.
