Licence - street trading
The City Council has adopted Section 3 and Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982 relating to street trading, and has designated all streets (or parts of streets) within the District as either "prohibited" or "consent" streets.
These provisions came into effect on 1 September 1984, and their effect is as follows:
No street trading at all will be permitted in a prohibited street and any person found trading in such a street will be guilty of an offence and liable on summary conviction to a fine not exceeding £1,000.
The attached notice lists these streets within the City Council's area which are designated as prohibited streets and indicates that every other street within the area is designated as a consent street. A consent street means a street in which street trading is prohibited without the consent of the Council.
If you wish to apply for a street trading consent please complete the application form and return it with:
- An accurate plan showing the precise location from which you wish to trade (or an indication of which streets/villages you will be operating in)
- Two recent passport-size photographs of yourself and any assistant(s)
- The appropriate fee (details below)
Any trader found to be operating in the Durham City district without a valid consent and accompanying trading plate will be considered to be in contravention of the above Act and liable to appropriate enforcement action by the Council.
Please note that in addition to a street trading consent you will also need planning permission and should contact Development Control for an application form and advice.
